Terms of Service

These Terms of Service ("Terms") are a contract between you and Seven Rivers Tech LLC, a New Mexico limited liability company ("Caracas Dream," "we," "us," or "our"). They cover your use of caracasdream.ai and any related apps or services (the "Service").

Please read them. By creating an account, buying anything, or using the Service, you agree to these Terms and to the policies they link to: the Privacy Policy, Refund & Cancellation Policy, Acceptable Use Policy, Underage / Child Safety Policy, AI Disclosure, DMCA Policy, Complaints & Content Removal Policy, and Cookie Policy. If you do not agree, do not use the Service.

Important: Section 14 says that most disputes must be settled by individual arbitration, not in court, and that you give up the right to join a class action. You can opt out within 30 days. See Section 14.

1. Adults only

  • You must be at least 18 years old, and old enough to view adult material where you live (in some places this is 19 or 21). If you are not, leave now.
  • You may only use the Service where viewing adult content is legal. You are responsible for following your local laws.
  • We may ask you to verify your age, including through a third-party age verification provider, where the law requires it or if we have doubts. If you do not complete verification, we may limit or close your account.
  • You agree not to let anyone under 18 see the Service or anything you get from it.

2. What the Service is

  • Caracas Dream lets you chat with AI companions. These are fictional characters with personalities and voices. The Service can also send you AI-generated images and videos, including sexually explicit content.
  • Every companion, message, voice, image, and video is created by artificial intelligence. No real people appear in or create this content. Companions are not real, do not have feelings, and cannot form real relationships. See our AI Disclosure.
  • The Service is for adult entertainment only. It is not medical, mental health, legal, financial, or any other professional advice, and it is not a crisis service.

3. Your account

  • You sign in through our login provider. Give accurate information and keep your login details safe.
  • One account per person. Do not share, sell, or transfer your account.
  • You are responsible for everything that happens under your account. Tell us right away at support@caracasdream.ai if you think someone else has used it.

4. Memberships

  • A membership is a one-time payment for 30 days of access, plus any tax shown at checkout. The price and what it includes are shown before you pay.
  • Memberships do not renew automatically. You will not be charged again unless you choose to buy another membership.
  • Memberships do not renew, so there is nothing to cancel. You keep access until the end of the 30 days you paid for.
  • If we ever raise the membership price, we will tell you by email at least 14 days before the new price applies.

5. Coins

  • You can buy coin packs with a one-time payment. Coins are used for chat, images, videos, and other features. The price of each feature in coins is shown in the Service.
  • Coin packs are not memberships and do not renew.
  • Coins are a license to use features of the Service. They have no cash value, cannot be exchanged for money, and cannot be transferred, sold, or gifted to another account.
  • Purchased coins do not expire while your account is open. If your account is closed for breaking these Terms, unused coins are lost.
  • We may change how many coins a feature costs. We will not change the price of a coin pack you already bought.

6. Refunds and chargebacks

  • Refunds follow our Refund & Cancellation Policy.
  • If you have a problem with a charge, please contact us first at support@caracasdream.ai. We usually fix billing problems faster than a bank dispute. If you file a chargeback, we may pause your account while it is reviewed.

7. Rules you must follow

  • You must follow our Acceptable Use Policy and Underage / Child Safety Policy. They list content that is never allowed, such as anything involving minors, real people without consent, non-consent, incest between blood relatives, bestiality, and extreme violence.
  • We use automated filters and human review to enforce these rules. If something is flagged, we may review the related chats and media.

8. Your content and AI output

  • "Your Input" means the messages, prompts, character settings, and anything else you send to the Service. "Output" means the text, voice, images, and video the Service creates for you.
  • You keep whatever rights you have in Your Input. You give us a worldwide, non-exclusive, royalty-free license to store, process, and use Your Input and Output to run, secure, moderate, and improve the Service. We do not publish your private chats or images.
  • You may use Output for your own personal, non-commercial use. You may not sell it, use it to depict a real person, or share it in a way that breaks the law or our rules.
  • AI can produce similar Output for different users. We do not promise that Output is unique, accurate, or free of third-party rights.
  • You must not submit anything you do not have the right to submit, including photos, voices, or names of real people.

9. Our property

The Service, including its software, design, characters we create, logos, and the name Caracas Dream, belongs to us or our licensors. You may not copy, scrape, reverse engineer, resell, or build a competing product from the Service.

10. Suspension and termination

  • You can stop using the Service and delete your account at any time.
  • We may remove content, limit features, suspend, or close your account if you break these Terms, if the law requires it, or to protect users or the Service. Serious violations (for example anything involving minors) lead to an immediate permanent ban and may be reported to authorities.
  • If we close your account for breaking these Terms, you are not entitled to a refund. If we stop offering the Service for reasons unrelated to you, we will refund the unused part of your current membership and your unused purchased coins.

11. Disclaimers

The Service is provided "as is" and "as available." AI can be wrong, strange, or offensive, and may not do what you ask. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose, merchantability, and non-infringement. We do not promise the Service will always be available or error-free.

12. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or US $100. Some places do not allow these limits, so they may not fully apply to you.

13. Indemnity

If your use of the Service, Your Input, or your breaking of these Terms causes a claim against us, you agree to cover our reasonable costs and losses, including legal fees, to the extent the law allows.

14. Disputes, arbitration, and class action waiver

  • Talk to us first. Email legal@caracasdream.ai with your name, account email, and what you want us to do. We will try to resolve it within 30 days.
  • If we cannot resolve it, you and we agree that any dispute will be settled by binding individual arbitration run by JAMS under its consumer rules, not in court. Either side may instead bring a claim in small claims court if it qualifies.
  • Class action waiver: claims may only be brought individually, not as part of a class, group, or representative action.
  • Opt out: you may opt out of arbitration by emailing legal@caracasdream.ai with the subject "Arbitration Opt-Out", your name, and your account email within 30 days of first accepting these Terms.
  • These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any case not subject to arbitration will be heard in the state or federal courts located in Bernalillo County, New Mexico, and both sides agree to those courts.
  • If you live in the European Economic Area, the United Kingdom, or another place where these rules are not allowed, you keep the rights your local consumer law gives you.

15. Changes to these Terms

We may update these Terms. We will post the new version with a new "Last updated" date. For important changes, we will also tell you by email or in the Service at least 14 days before they take effect. If you keep using the Service after that, you accept the new Terms.

16. Other terms

  • Third-party services have their own terms. We are not responsible for them.
  • If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a rule right away, we have not given up the right to enforce it later.
  • These Terms and the linked policies are the full agreement between you and us about the Service. You may not transfer them; we may transfer them as part of a merger, sale, or reorganization.
